Intrusion occurs when one intentionally intrudes, physically or otherwise, upon the solitude or seclusion of another or his private affairs or concerns. The form of intrusion can take many forms. A party that does so can be subject to liability to the other if the intrusion would be highly offensive to a reasonable person.
Public Disclosure of Private Facts occurs when one unreasonably and seriously interferes with another’s interest in not having his or her affairs known to others. This generally occurs when a party discloses a private fact about another party publicly and the disclosure is such that it would be highly offensive and unreasonable to an objective person.
One who gives publicity to a matter concerning another that places the other before the public in a false light is subject to liability to the other for invasion of privacy if the false light in which the other was placed would be highly offensive to a reasonable person and the party that did this had knowledge of or acted in reckless disregard as to the falsity of the publicized matter and the false light in which the other would be placed.
One who uses another’s likeness for commercial purposes may also be held liable for invasion of privacy. For instance, one who uses another’s picture obtained without their consent and/or knowledge for commercial gain, may have invaded the other’s privacy and be liable to the other for damages.
